TextQuest Terms of Service

These Terms of Service ("Terms") are an agreement between you and TextQuest Games Ltd. ("TextQuest," "we," "us," or "our") governing your use of textquest.games, our web games, and our games played by text message (SMS/MMS) or WhatsApp (together, the "Services"). By accessing or using the Services, including by texting our number, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Please read the Dispute Resolution section carefully. It requires most disputes to be resolved through individual binding arbitration and waives your right to a jury trial and to take part in a class action.

Eligibility

You must be at least 13 years old to use the Services. If you are under 18, or under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. To use the text messaging features, you must be the account holder for the mobile number you use or have the account holder's permission.

The Services

TextQuest offers interactive fantasy text adventure games. You play by typing commands and choices, and the game responds with story text. Games may be available on the web, by SMS and by WhatsApp. We may add, change, suspend or discontinue any game or feature at any time, and the Services may be unavailable from time to time for maintenance or for reasons outside our control.

Text messaging program terms

• Program description. The TextQuest messaging program lets you play text adventure games by SMS and WhatsApp. Messages include game story text, replies to your moves, and occasional service messages such as reminders and updates about your game.
• How to opt in. You join by texting a keyword such as START or PLAY to (650) 460-3336, or by submitting your number on our website and confirming by text. By opting in, you agree to receive recurring automated text messages from TextQuest at the number you provided. Consent is not a condition of any purchase.
• Game numbers. Some games may continue your adventure from their own TextQuest game number. Your sign-up covers all TextQuest numbers, and replying STOP to any of them stops messages from all of them.
• Message frequency. Message frequency varies and depends on how often you play.
• Costs. Message and data rates may apply. You are responsible for any charges from your mobile carrier. TextQuest does not charge for messages unless a paid feature is clearly offered and you agree to it separately.
• How to opt out. Reply STOP at any time to stop receiving messages. You will receive one confirmation message and no further messages unless you opt in again by texting START.
• Help. Reply HELP for help, or email gamemaster@textquest.games.
• Carriers. Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device, and we do not guarantee that every message will be delivered or delivered on time.
• Changing numbers. If you change or give up your mobile number, reply STOP from that number first, or contact us, so messages are not sent to the new holder of the number.
• Privacy. Our handling of your phone number and messages is described in our Privacy Policy at textquest.games/privacy.html. We do not share your mobile number or messaging consent with third parties for their marketing purposes.

If you play on WhatsApp, you must also comply with WhatsApp's terms of service.

Accounts

Some features may require an account. You agree to give accurate information, keep your login details secure, and tell us promptly if you believe your account has been used without your permission. You are responsible for activity on your account and on the phone number you use to play.

Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Send content that is harassing, hateful, threatening, sexually explicit, or that exploits or harms minors.
• Send spam, flood the Services with messages, or use bots or scripts to play or to overload our systems.
• Attempt to hack, reverse engineer, scrape or interfere with the Services, or get around any security or usage limits.
• Try to make the game produce harmful or illegal content, or misuse any automated story generation.
• Impersonate any person or use a phone number you are not authorized to use.
• Send personal information about other people without their permission.

Your content

You keep ownership of the text you send to the Services ("Your Content"). You grant TextQuest a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to use, store, reproduce, modify and display Your Content to operate, provide and improve the Services, including to develop and refine our games. You are responsible for Your Content and confirm that you have the right to send it.

Our content and intellectual property

The Services, including the games, stories, characters, artwork, logos, the TextQuest name and all software, are owned by TextQuest or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial entertainment. You may not copy, distribute, sell or create derivative works from our content without our written permission. Story text generated during your game is provided for your personal enjoyment, and we may reuse similar content for other players.

Virtual items and paid features

The Services may include virtual items, in-game currency, rewards or paid features. These have no real-world monetary value, cannot be exchanged for cash, and are licensed to you rather than sold. Additional terms may apply to purchases and rewards, and will be shown to you before you buy or claim them. Except where required by law, purchases are non-refundable.

Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

Third-party services

The Services rely on third-party providers, such as mobile carriers, messaging platforms and WhatsApp, and may link to third-party websites. We are not responsible for third-party services, and your use of them is governed by their own terms.

Termination

You may stop using the Services at any time, and you can stop text messages by replying STOP. We may suspend or end your access, block your number or delete your game data at any time if you violate these Terms or if we believe it is necessary to protect the Services or other players. Sections that by their nature should survive termination will survive, including those on intellectual property, disclaimers, limitation of liability and dispute resolution.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT MESSAGES WILL BE DELIVERED, OR THAT GAME PROGRESS WILL ALWAYS BE SAVED. The games are works of fiction for entertainment only, and nothing in them is professional, financial, medical or other advice.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TEXTQUEST AND ITS OWNERS, EMPLOYEES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50 (USD). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless TextQuest from any claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, Your Content, or your misuse of the Services.

Dispute resolution and arbitration

Informal resolution. Before filing a claim, you agree to contact us at gamemaster@textquest.games and try to resolve the dispute informally for at least 30 days.

Binding arbitration. If we cannot resolve it informally, you and TextQuest agree that any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies.

Class action waiver. You and TextQuest agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing gamemaster@textquest.games within 30 days of first accepting these Terms.

Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Subject to the arbitration section, any court proceedings will take place in the state or federal courts located in the City and County of Denver, Colorado.

Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, notify you through the Services, by email or by text message. Continuing to use the Services after changes take effect means you accept the updated Terms.

General

These Terms and our Privacy Policy are the entire agreement between you and TextQuest about the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a business transfer.
